Terms of Service
Effective July 2, 2026
Welcome to A Little Birdie. These Terms of Service ("Terms") govern your access to and use of the website at alittlebirdie.app and the A Little Birdie background intelligence service (collectively, the "Service"), operated by Verity Search LLC, doing business as A Little Birdie ("A Little Birdie," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Please read Section 16 (Dispute Resolution) carefully. It requires that most disputes between you and us be resolved through binding individual arbitration, and it waives your right to a jury trial and to participate in a class action, unless you opt out within 30 days.
1. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age, have the legal capacity to enter into these Terms, are using the Service on your own behalf and not on behalf of an undisclosed third party, and that all information you provide to the Service is accurate to the best of your knowledge.
2. Description of Service
A Little Birdie is a background intelligence platform that uses AI-powered agents to search publicly available information about individuals. Our agents search public records, social media profiles, professional license databases, court records, news archives, and other publicly accessible sources to compile informational reports.
Reports are generated by artificial intelligence. AI systems can misread, mismatch, or misstate source material. Reports are a starting point for your own judgment and verification, not a substitute for it.
Important FCRA Notice
A Little Birdie is not a consumer reporting agency as defined by the Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681 et seq. Reports generated by the Service are not consumer reports and may not be used, in whole or in part, for any FCRA-regulated purpose, including determining a person's eligibility for credit, employment, insurance, housing, or any other purpose that would require FCRA compliance.
3. Permitted and Prohibited Uses
3.1 Permitted Uses
You may use the Service for lawful, personal, informational purposes, such as:
- Verifying someone you recently met
- Learning about a potential roommate
- Looking up publicly available information about an individual for personal peace of mind
3.2 Prohibited Uses
You may not use the Service, or any information obtained from it, for any of the following purposes:
- Employment screening: making hiring, firing, promotion, retention, or reassignment decisions about any employee, contractor, or volunteer, including household workers such as nannies, caregivers, and domestic staff
- Tenant screening: evaluating rental or housing applications
- Credit decisions: determining credit eligibility or terms
- Insurance underwriting: evaluating insurance eligibility or rates
- Educational or benefit eligibility: decisions about admissions, scholarships, government licenses, or government benefits
- Any FCRA-regulated purpose: any decision about a consumer's eligibility for credit, employment, insurance, housing, or other benefits
- Stalking, harassment, intimidation, or surveillance of any person
- Locating a protected person: attempting to locate any individual who has a restraining order, protective order, or no-contact order against you, or whom you are otherwise prohibited from contacting
- Doxxing: publishing or distributing information about a person with the intent to threaten, harass, or cause harm
- Searching minors: requesting a report on any person you know or believe to be under 18
- Identity theft, fraud, or impersonation of any kind
- Any purpose regulated by the Driver's Privacy Protection Act (DPPA) or the Gramm-Leach-Bliley Act (GLBA), or any other purpose that violates federal, state, or local law
- Automated access: accessing the Service through bots, scrapers, or other automated means without our written permission, or probing, circumventing, or testing the security of the Service
- Redistribution: reselling, licensing, or systematically redistributing reports or report data
Each time you run a search, you certify that you will not use the results for any prohibited purpose. We reserve the right to investigate suspected misuse, refuse or limit searches, suspend or terminate accounts, and cooperate with law enforcement and civil litigants (including responding to lawful subpoenas) in connection with any misuse of the Service. These restrictions survive termination of your account.
4. Not Professional Advice; Your Decisions Are Your Own
The Service provides information, not advice. Reports do not constitute legal, financial, safety, or investigative advice, and no attorney-client, investigator-client, or fiduciary relationship is created by your use of the Service. You are solely responsible for any decision or action you take based on a report, including decisions about personal relationships and personal safety. Before acting on any significant finding, independently verify it through official sources, such as the court or agency that maintains the underlying record.
5. Accounts and Authentication
Some features of the Service require you to create an account or authenticate through a third-party provider. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate registration information and to notify us immediately of any unauthorized use of your account. You may stop using the Service and request deletion of your account at any time by contacting us at the address in Section 19.
6. Payments and Refunds
6.1 Pricing
The Service offers individual report purchases and subscription plans. Current pricing is displayed on the Service at the time of purchase. Prices are exclusive of any applicable taxes, which are your responsibility. We reserve the right to change pricing at any time, but changes will not affect previously completed purchases.
6.2 Payment Processing
Payments are processed by Stripe, a third-party payment processor. By making a purchase, you agree to Stripe's terms of service. We do not store your full payment card information on our servers.
6.3 Refunds
Because reports are generated instantly using AI-powered searches, we generally cannot offer refunds once a report has been delivered. However, if you believe a report was generated in error or the Service malfunctioned, please contact us at alittlebirdie.app@gmail.com and we will review your request on a case-by-case basis. Initiating a chargeback for a report that was delivered as described, instead of contacting us first, may result in suspension of your account.
7. Report Accuracy and Limitations
Reports are compiled from publicly available information and third-party data sources we do not control, and are processed by AI. While we strive for accuracy, you acknowledge and agree that:
- Reports may be incomplete: not all information about a person is publicly available or discoverable by our agents, and some sources may be unavailable at the time of your search.
- Reports may contain inaccuracies: public records may be outdated or wrong at the source, and AI processing may introduce errors, including misattributed or fabricated details.
- Reports may reference the wrong person: individuals with similar names or details may be confused, and it is your responsibility to confirm that a record actually concerns the person you searched.
- A report showing no adverse information is not a guarantee that a person is safe, trustworthy, or has no adverse history. Records may be sealed, non-digitized, indexed under a different name, or outside the sources we search.
- Reports are provided "as is" and should not be used as the sole basis for any important decision.
- We do not guarantee the accuracy, completeness, timeliness, or reliability of any information in a report.
8. If a Report Is About You
If you believe a report about you contains information that is inaccurate or misattributed, contact us at alittlebirdie.app@gmail.com and we will review the issue. Where we confirm an error in how our Service compiled or presented information, we will correct or suppress it in future reports where reasonably feasible. Please note that we do not control the underlying public records and third-party sources; correcting or removing a source record itself must be done with the court, agency, or website that maintains it, and information we suppress may remain publicly available elsewhere.
9. Intellectual Property
The Service, including its design, branding, software, and AI agents, is owned by Verity Search LLC (d/b/a A Little Birdie) and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.
Reports generated for you are provided for your personal use. You may share report contents with others at your discretion, subject to Section 3, but you may not systematically redistribute, resell, or commercially exploit report data.
If you submit feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or compensation.
10. User Content and Conduct
You are responsible for the information you provide to the Service (e.g., search inputs, uploaded photos, feedback). You represent that you have the right to submit any content you provide, and you agree not to submit false, misleading, or malicious information or content that infringes any third party's rights. We reserve the right to refuse service or terminate accounts that violate these Terms or engage in abusive behavior.
11. Privacy
Our collection and use of personal information in connection with the Service is described in our Privacy Policy, which is incorporated into these Terms by reference.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY INFORMATION PROVIDED THROUGH THE SERVICE WILL BE ACCURATE OR COMPLETE. WITHOUT LIMITING THE FOREGOING, WE MAKE NO WARRANTY THAT ANY PERSON WHO IS THE SUBJECT OF A REPORT IS OR IS NOT SAFE, TRUSTWORTHY, OR FREE OF ADVERSE HISTORY. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VERITY SEARCH LLC (D/B/A A LITTLE BIRDIE) AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE, THE CONTENT OF ANY REPORT, ANY DECISION YOU MAKE OR ACTION YOU TAKE IN RELIANCE ON A REPORT, OR ANY CONDUCT OF ANY THIRD PARTY, INCLUDING ANY PERSON WHO IS THE SUBJECT OF A REPORT.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU; IN THAT CASE, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
14. Indemnification
You agree to indemnify, defend, and hold harmless Verity Search LLC (d/b/a A Little Birdie) and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the Service; (b) your violation of these Terms; (c) your use of report information for any prohibited purpose; or (d) your violation of any law or the rights of any third party, including any person who is the subject of a report you requested.
15. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Sections 3, 4, 7, 9, and 12 through 18) will continue to apply.
16. Dispute Resolution: Arbitration and Class Action Waiver
16.1 Informal Resolution First
Before filing a claim, you agree to first contact us at alittlebirdie.app@gmail.com with a written description of the dispute and give us 60 days to work with you to resolve it informally. Most concerns can be resolved this way.
16.2 Binding Arbitration
Except as provided in Section 16.4, any dispute, claim, or controversy arising out of or relating to these Terms or the Service that is not resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The Federal Arbitration Act governs the interpretation and enforcement of this Section. The arbitration will be conducted by a single arbitrator, in English, and may proceed by videoconference or written submissions where the AAA rules allow. Judgment on the award may be entered in any court of competent jurisdiction.
16.3 Class Action and Jury Trial Waiver
YOU AND A LITTLE BIRDIE EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR OTHER REPRESENTATIVE PROCEEDING. Disputes may be brought only on an individual basis, and the arbitrator may not consolidate claims of more than one person. If this class action waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall proceed in court rather than in arbitration.
16.4 Exceptions
Either party may bring an individual claim in small claims court, and either party may seek injunctive or other equitable relief in court for infringement or misuse of intellectual property or for misuse of the Service described in Section 3.2.
16.5 Opt-Out
You may opt out of this arbitration agreement by emailing alittlebirdie.app@gmail.com within 30 days of first accepting these Terms, with the subject line "Arbitration Opt-Out" and your account email. Opting out of arbitration does not affect any other provision of these Terms.
16.6 Governing Law and Venue
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. For any dispute not subject to arbitration, you and we consent to the exclusive jurisdiction of the state and federal courts located in Delaware.
17. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Effective" date at the top of this page and take reasonable steps to notify you, such as a notice on the Service or an email to the address on your account. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, stop using the Service.
18. Miscellaneous
Severability. If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and A Little Birdie regarding the Service and supersede all prior agreements and understandings.
Assignment. You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.
No Waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.
Force Majeure. We are not liable for any delay or failure to perform resulting from causes outside our reasonable control, including outages of third-party data sources, hosting providers, or AI model providers.
Electronic Communications. You consent to receive communications from us electronically, and you agree that those communications satisfy any legal requirement that they be in writing.
